Devastating Auto Accident Statistics

Thousands of auto accidents occur on our nation's roads and highways every day in the United States; these collisions can be devastating for the unlucky passenger and the innocent bystander. As a result, millions of people are injured and thousands killed in car accidents across our nation each year. These unforeseen tragedies can occur in a split second and may carry consequences that last a life time.

According to a 2007 report by The National Highway Traffic Safety Administration, 41,059 people were killed and 2,491,000 people were injured in motor vehicle crashes.

It is a fact that Americans, ranging from the ages of 1-33, have more of a chance to die in an automobile accident than from anything else. Statistics also show that in the last five years, approximately one-quarter of the American population has been involved in a car accident. Americans spent over $719.2 million in collision related expenses last year alone.

Driving Laws Protect You

There are laws that govern how a person is supposed to drive or operate an automobile. These laws are designed to ensure the safety of the operator as well as the safety of all others around them. Unfortunately all too often people do not adhere to these laws. In many accidents, one of the parties involved is to blame.

Manufacturer Defects

Manufactures' defects of the vehicle or parts (such as tires) can cause harmful and deadly accidents. It is not uncommon for manufactures' defects of these vehicles or parts to cause auto rollover accidents which can be the most serious and fatal accidents that occur. Even though automotive manufactures continue to claim that their cars, trucks and sport utility vehicles are becoming safer every year, even the best safety precautions are worthless in the wrong situation.

Auto Accident FAQ

What should I do if I am in an auto accident?

The police should immediately be called so that a report may be made at the scene. Medical treatments should be immediately received for any injuries that you may be suffering from. Keep in mind that the shock of being in a collision many times hides any pain until hours or even days later. Do not speak to the at-fault driver's insurance company about your injury or do not consent to a recorded statement. Seek the advice of an attorney as soon as possible.

  1. Stop and protect the scene of the accident.

The law requires that you stop after you are involved in an accident. Try to preserve the scene as best as you can, but if your vehicle is blocking traffic, and it is moveable, you must move it to the side of road as soon as possible.

  2. Notify the Proper Authorities.

Although the law only requires you to report an accident if there is injury involved, or if the property damage exceeds $500.00, it is a good idea to always notify the proper authorities so that your accident and any injuries can be properly documented. This can aid you in a personal injury claim that you may have in the future. In addition, you should report the accident to your insurance company.

  3. Gather Information.

Get the name, address, telephone number and insurance information for all drivers involved. In addition, get the names and phone numbers of any witnesses to your accident, if possible. Try to make a simple diagram of the accident scene as soon as possible so that you can later confirm it with the diagram on the accident report. Take photos of your vehicles damages as soon as possible. In addition, take photographs of your injuries including all cuts and bruises.

  4. Provide Information to the Proper Authorities Only.

Never admit responsibility. Statements to witnesses and onlookers at the scene could be used against you, should you have to go to traffic or civil proceedings. Only give information to the responding officer(s) or to the driver of the other vehicle when exchanging information.

  5. Seek Medical Attention if You are in Pain.

Many times, people don't seek medical treatment after an auto accident because they feel they are fine, only to wake up the following day with severe pain. It is very important to document your injuries and treatments as soon as possible in order to obtain complete compensation. A doctor may recognize injuries that are not apparent to you.

  6. Contact a Lawyer to Discuss your Rights.

What if the other party does not have insurance?

Even though the other party may not have liability insurance this does not mean that no insurance may be available. If you have purchased uninsured motorist coverage, a recovery is available. This insurance coverage may be available for any injury you have received. In addition, potential causes of action against parties not initially known may be available such as the Department of Transportation due to negligent road design, as an example.

The adjuster for the other driver keeps calling my home?

It is best not to talk to an adjuster until you have had the opportunity to speak to a lawyer. Keep in mind the adjuster works for the other drivers insurance company. Their job is to pay you no money at all or as little as possible.

Do I have to go to court?

Most personal injury cases are settled prior to going to court. The instances when a trial is needed is when the insurance company refuses to settle for the true value of the claim.
